This document (as well as other documents mentioned herein) regulates the conditions governing the use of this Website www.ifevet.com and the acquisition and access to the products and/or services therein (hereinafter, «Conditions»).
In addition to reading these Conditions, before accessing, browsing and/or using this website, the User must have read the Legal Notice, the cookie policy, the privacy and data protection policy of IFEVET. By using this Website or by making and/or requesting the acquisition of a product and/or service through it, the User agrees to be bound by these Conditions and by all of the above, so if you do not agree with all of this, you should not use this Website.
Likewise, you are informed that these Conditions may be modified. The User is responsible for consulting them each time he/she accesses, browses and/or uses the Website, since those in force at the time when the acquisition of products and/or services is requested will be applicable.
For any questions the User may have regarding the Conditions, he/she may contact the owner using the contact details provided above or, where appropriate, using the contact form.
- THE USER
Access, navigation and use of the Website confers the status of user (hereinafter referred to, indistinctly, individually as User or jointly as Users), and therefore, from the moment navigation on the Website begins, all the Conditions established herein are accepted, as well as any subsequent modifications, without prejudice to the application of the corresponding mandatory legal regulations as the case may be.
The User assumes responsibility for the correct use of the Website. This responsibility shall extend to:
– Use this Website only for legally valid queries and access.
– Do not perform any false or fraudulent actions. If it could reasonably be considered that such an action has been carried out, the service will be suspended and the relevant authorities will be informed.
– Provide true and lawful contact information, for example, email address, postal address and/or other contact information (see Legal Notice).
The User declares to be over 18 years of age and to have the legal capacity to enter into contracts through this Website.
The Website is aimed at Users of international scope.
The User may formalize, at his/her discretion, with IFEVET the contract of sale of the desired products and/or services in any of the languages in which these Conditions are available on this Website.
- SERVICES OFFERED BY THE WEBSITE
3.1. The Website enables the use of services (collectively referred to as the «Services»), including EVENTS (training, consultative, DISCUSSION FORUMS and GROUP MANAGEMENT) for the purpose of interconnecting users and/or professionals in the veterinary sector. Unless otherwise specified, these Conditions apply to all Services offered by IFEVET, provided that they are compatible. IFEVET may entrust the execution of the Services to third party subcontractors or subsuppliers.
3.2. In order to access the Services, it is necessary to register on the Website in the relevant area reserved for the User. During registration, Users will be asked to specify whether they intend to register and therefore carry out actions as a company, sole proprietorship or self-employed person, individual or association, also specifying the country of the User’s headquarters or domicile. Only purchases of Services made by individual Users will be subject to the applicable consumer regulations in force in the User’s country of residence or domicile.
3.3. All final prices of the Services displayed on the Website are shown in Euros and can be displayed with or without VAT, depending on the country or type of registration. The prices of the Services may be subject to periodic variations.
3.4 The payment methods accepted at the discretion of the person responsible may be Transfer, Bank Card, Postal Order, PayPal and/or Bizum.
- REGISTRATION PROCESS AND AVAILABILITY
4.1. Duly registered Users may access the Website by the established means and methods. They must follow the online access and/or registration procedure of www.ifevet.com,
Likewise, the User must fill out and/or check the information requested at each step,
4.2. The User will then receive an email confirming that IFEVET has received their request for the provision of the service.
4.3. Once the registration procedure has been completed, the User agrees that the Website may generate an electronic invoice, where appropriate, which will be sent to the User by email and, where appropriate, through his/her personal connection space on the Website. Likewise, the User may, if he/she so wishes, obtain a copy of his/her invoice in paper form, by requesting it from IFEVET using the contact spaces on the Website or through the contact details provided above.
4.4 The User acknowledges that he/she is aware, at the time of registration, of certain specific conditions concerning the service in question and which are displayed alongside the presentation; and acknowledges that the completion of such registration or order materialises the full and complete acceptance of the specific conditions of the service applicable to each case.
4.5 Communications, requests and all procedures involved in transactions carried out on the Website may be archived and kept in IFEVET’s computerized records in order to constitute a means of proof of the transactions, in any case, respecting reasonable security conditions and the laws and regulations in force that are applicable in this regard, and particularly taking into account Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data (RGPD) and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, and the rights that assist Users in accordance with the privacy policy of this Website.
4.6. IFEVET reserves the right, at its sole discretion, not to proceed with any registration. This may also occur in the event that:
– the data provided by the User when completing the order form are incomplete or incorrect;
– the User does not comply with the relevant legal requirements;
– the requested services are not available.
In the cases mentioned above, IFEVET will inform the User, by email, that the order proposal has not been accepted (in whole or in part), specifying the reasons and, therefore, the contract has not been formalized. In this case, IFEVET will reimburse the User for the amount that he or she may have paid.
4.7. IFEVET reserves the right at any time it deems appropriate to modify, alter or discontinue, temporarily or permanently, the service, or any part thereof, with or without prior notice. Furthermore, IFEVET shall not be liable to you or any third party for any alteration, modification, suspension and/or interruption of our services, or any part thereof.
4.8. As a registered member of the IFEVET social network, you may cancel or terminate your account, associated email address, and/or access to our Services by submitting a written cancellation or termination request. As a member, you agree that IFEVET may, without any prior written notice, immediately suspend, terminate, suspend, and/or limit your account, any email address associated with your account, and access to any of our Services. The reason for such termination, interruption, suspension, and/or limitation of access shall include, but is not limited to:
– any breach or violation of our Terms of Service or any other incorporated agreement, regulation and/or guideline;
– through requests from law enforcement or any other government agency;
– the suspension, alteration and/or material modification to our Services or any part thereof;
– unexpected technical or security issues and/or problems;
– any prolonged periods of inactivity;
– any engagement by you in any fraudulent or illegal activity;
– failure to pay all associated costs that may be owed by you in relation to your IFEVET account.
4.9. You further agree that any and all terminations, suspensions, discontinuances and/or limitations of access for cause shall be made at our sole discretion and that we shall not be liable to you or any third party with respect to any termination of your account, associated email address and/or access to any of our Services.
- BUG FIXING
5.1. Users are hereby informed that if they detect that an error has occurred when entering the data required to process their registration request on the Website, they may modify the data by contacting IFEVET through the contact spaces provided on the Website and, where applicable, through those provided for contacting customer service, and/or using the contact details provided in the first clause (General information). Likewise, this information may also be corrected by the User through their personal connection space on the Website.
5.2. In any case, the User, before validating the registration, may make modifications.
5.3. Likewise, the User is referred to consult the Legal Notice and, specifically, the Privacy Policy to gather more information on how to exercise their right to rectification as established in Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data (RGPD) and in Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights.
- WARRANTIES
6.1. The User, as a consumer and user, enjoys guarantees on the products and/or services that may be acquired through this Website, in the terms legally established for each type of product and/or service, IFEVET being therefore responsible for any lack of conformity thereof that becomes apparent within a period of two years from the delivery of the product.
6.2. In this sense, it is understood that the products and/or services comply with the contract provided that: they conform to the description made by IFEVET and possess the qualities presented therein; they are suitable for the uses to which products and/or services of the same type are ordinarily intended; and they present the quality and performance that are usual for a product and/or service of the same type and that are fundamentally expected of it.
- DISCLAIMER
7.1. Unless otherwise provided by law, IFEVET will not accept any liability for the following losses, regardless of their origin:
– any losses which were not attributable to any breach on your part;
– business losses (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or unnecessary expenditure); or
– any other indirect loss that was not reasonably foreseeable by both parties at the time the contract of sale of the products was concluded between both parties.
7.2. Likewise, IFEVET also limits its liability in the following cases:
– IFEVET applies all measures concerning providing a faithful display of the product and/or service on the Website, however it is not responsible for any minor differences or inaccuracies that may exist due to lack of screen resolution, or problems with the browser used or others of this nature.
– Technical failures that, for unforeseen or other reasons, prevent the normal operation of the service via the Internet. Lack of availability of the Website for maintenance or other reasons, which prevents the service from being available. IFEVET uses all means at its disposal to carry out the registration process and/or provide the service, however it is exempt from liability for causes that are not attributable to it, such as unforeseen events or force majeure.
– IFEVET will not be responsible for the misuse and/or wear and tear of the products and/or services that have been used by the User.
– In general, IFEVET will not be liable for any failure or delay in the fulfillment of any of the obligations assumed, when this is due to events that are beyond its reasonable control, that is, due to force majeure, and this may include, but is not limited to:
- a) Strikes, lockouts or other protest measures.
- b) Civil commotion, riot, invasion, threat or terrorist attack, war (declared or not) or threat or preparation for war.
- c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
- d) Inability to use trains, ships, planes, motor vehicles or other means of transport, public or private.
- e) Inability to use public or private telecommunications systems.
- f) Acts, decrees, legislation, regulations or restrictions of any government or public authority.
7.3. In this way, the obligations will be suspended during the period in which the cause of force majeure continues, and IFEVET will have an extension in the period to comply with them for a period of time equal to the duration of the cause of force majeure. IFEVET will use all reasonable means to find a solution that allows it to comply with its obligations despite the cause of force majeure.
- COMMUNICATIONS
8.1. By using this Website, the User agrees that most communications with IFEVET will be electronic (email or notices posted on the Website).
For contractual purposes, the User agrees to use this electronic means of communication and acknowledges that all contracts, notifications, information and other communications that IFEVET sends electronically comply with the legal requirements of being in writing. This condition will not affect the rights recognized by law to the User.
8.2. The User may send notifications and/or communicate with IFEVET through the contact details provided in these Conditions and, where applicable, through the contact spaces on the Website.
8.3. Likewise, unless otherwise stipulated, IFEVET may contact and/or notify the User by email or at the postal address provided.
- WAIVER
9.1. No waiver by IFEVET of any specific right or legal action or failure by IFEVET to require strict compliance by the User of any of its obligations shall constitute a waiver of any other rights or actions arising from a contract or the Conditions, nor shall it exonerate the User from compliance with its obligations.
9.2. No waiver by IFEVET of any of these Conditions or of the rights or actions derived from a contract will take effect, unless it is expressly established that it is a waiver and is formalized and communicated to the User in writing.
- NULLITY
If any of these Conditions were declared null and void by a final decision issued by a competent authority, the remaining clauses will remain in force, without being affected by said declaration of nullity.
- INTEGRITY OF THE AGREEMENT
11.1. These Conditions and any document expressly referred to herein constitute the entire agreement between the User and IFEVET in relation to the object of sale and replace any other previous agreement, pact or promise agreed verbally or in writing by the same parties.
11.2. The User and IFEVET acknowledge that they have agreed to enter into a contract without having relied on any statement or promise made by the other party, except for that which is expressly mentioned in these Conditions.
- DATA PROTECTION
Any personal information or data provided by the User to IFEVET during a transaction on the Website will be processed in accordance with the provisions of the Privacy Policy or data protection policy (contained, where applicable, in the Legal Notice, Privacy Policy and Cookies Policy). By accessing, browsing and/or using the Website, the User consents to the processing of such information and data and declares that all information or data provided is true.
- RIGHT OF WITHDRAWAL
13.1. The User, as a consumer and user, makes a subscription on the Website and, therefore, has the right to withdraw from said subscription within a period of 14 calendar days without the need for justification.
13.2. To exercise this right of withdrawal, the User must notify IFEVET of his/her decision. This may be done, where appropriate, through the contact spaces provided on the Website. The User, regardless of the means chosen to communicate his/her decision, must clearly and unequivocally express his/her intention to withdraw from the subscription contract. In any case, the User may use the withdrawal form template that IFEVET makes available to him/her as an annex to these Conditions; however, its use is not mandatory.
13.3. To comply with the withdrawal period, it is sufficient that the communication unequivocally expressing the decision to withdraw is sent before the relevant period expires.
13.4 In the event of withdrawal, IFEVET will reimburse the User for all payments received. 13.5. IFEVET will reimburse the User using the same payment method that the User used to make the initial purchase transaction. This reimbursement will not generate any additional costs for the User.
13.6. The User acknowledges that there are exceptions to the right of withdrawal, as set out in article 103 of Royal Legislative Decree 1/2007, of 16 November, approving the revised text of the General Law for the Defence of Consumers and Users and other complementary laws. This would be the case of personalised products or services, which may deteriorate or expire quickly;
The provision of a service that the User may contract on this Website is governed in the same way, since this same Law establishes that the Right of withdrawal will not assist Users when the provision of the service has been completely executed, or when it has begun, with the express consent of the consumer and user and with the recognition on their part that they are aware that, once the contract has been completely executed by IFEVET, they will have lost their right of withdrawal.
13.7. In the event of changes to the dates of the training weekends initially indicated on the website and in the brochures, ifevet international will not refund the total amount or the proportional part of the weekends affected by the change.
- JURISDICTION AND APPLICABLE LEGISLATION
14.1. Access, navigation and/or use of this Website shall be governed by Spanish law.
14.2. Any controversy, problem or disagreement arising from or related to access, navigation and/or use of the Website, or with the interpretation and execution of these Conditions, or with the sales contracts between IFEVET and the User, shall be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals.
- COMPLAINTS AND CLAIMS
15.1. The User may send IFEVET any complaints, claims or any other comments they wish to make through the contact details provided at the beginning of these Conditions (General Information).
15.2. In addition, IFEVET has official complaint forms available to consumers and users, which they can request from IFEVET at any time, using the contact information provided at the beginning of these Conditions (General Information).
15.3. Furthermore, if a dispute arises from the conclusion of this purchase contract between IFEVET and the User, the User as a consumer may request an extrajudicial solution to disputes, in accordance with Regulation (EU) 524/2013 of the European Parliament and of the Council, of May 21, 2013, on the resolution of online disputes for consumer matters and amending Regulation (EC) 2006/2004 and Directive 2009/22/EC.
